These Terms of Use ("Terms") govern your use of cobrainsurance.health (the "Site"), operated by HealthLink Insurance Agency LLC ("HealthLink," "we," "us"), an independent licensed insurance agency located in Springfield, Illinois. By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
1. Who We Are — and Who We Are Not
HealthLink is a private, independent insurance agency. To be clear:
- We are not a government agency, and this Site is not a government website. This Site is not the Health Insurance Marketplace® website; the official Marketplace is HealthCare.gov. Official information about COBRA is available from the U.S. Department of Labor at dol.gov/cobra.
- We are not your employer's COBRA plan administrator. We cannot elect, pay for, reinstate, or cancel COBRA coverage on your behalf. Those actions are handled by your former employer or its designated plan administrator, identified in your COBRA election notice.
- We are compensated by insurance companies when you enroll in coverage through us. Our services are free to you, and this compensation does not change the premium you pay.
2. Informational Content Only — No Legal, Tax, or Benefits Advice
Content on the Site — including articles, guides, calculators, comparison tables, and the state-law summaries — is provided for general informational purposes only. It is not legal, tax, financial, or employee-benefits advice, and it is not a substitute for the official plan documents, notices, statutes, and regulations that govern your rights. Laws, regulations, premiums, subsidies, plan availability, and deadlines change frequently and vary by state and by plan, and content may be outdated or contain errors despite our efforts. Always verify deadlines and rights with your plan administrator, the U.S. Department of Labor, your state insurance department, or your own advisors before acting.You are responsible for decisions you make in reliance on Site content, including decisions about electing, declining, or canceling coverage.
3. Insurance Services; No Guarantee of Coverage
Licensed advisors are available to help you compare and apply for insurance products. However:
- Nothing on the Site is an offer of insurance or a guarantee of eligibility, availability, premium rates, subsidy amounts, provider-network participation, or coverage.
- Quotes and estimates (including calculator outputs) are estimates only and are subject to change by the insurance carrier or marketplace.
- Coverage exists only when an insurance carrier issues a policy, and the terms of the issued policy and applicable law control over anything on this Site or said by an advisor.
- Product availability varies by state. Certain products described on the Site (including short-term medical plans) are not available in all states.
- We operate only in states where we hold an active insurance license; a current list appears on our About page. We do not solicit insurance in states where we are not licensed.
4. Eligibility
The Site is intended for use by individuals 18 years of age or older who are located in the United States.
5. Your Communications Consent
If you submit a form with your phone number and the accompanying consent language, your consent to receive calls and texts (including autodialed, prerecorded, artificial-voice, and AI-assisted calls and SMS messages) is governed by that consent language and Section 3 of ourPrivacy Policy. Consent is not a condition of purchase. Message and data rates may apply; message frequency varies; reply STOP to cancel, HELP for help. Supported carriers are not liable for delayed or undelivered messages.
6. Acceptable Use
You agree not to: (a) use the Site for any unlawful purpose; (b) submit false, misleading, or another person's information without authorization; (c) scrape, harvest, or copy Site content or data by automated means; (d) interfere with the Site's operation or security, or attempt to access non-public areas or systems; (e) frame or mirror the Site; or (f) use the Site to develop a competing product or to train artificial-intelligence models.
7. Intellectual Property
The Site and its content — including text, guides, tables, calculators, graphics, logos, and software — are owned by HealthLink or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive license to access and use the Site for personal, non-commercial purposes. All other rights are reserved. "Health Insurance Marketplace®" is a registered service mark of the U.S. Department of Health & Human Services; other marks belong to their respective owners, and no affiliation or endorsement is implied.
8. Third-Party Sites and Services
The Site may link to third-party websites, including carrier sites, HealthCare.gov, and state resources. We do not control and are not responsible for third-party sites, and linking does not imply endorsement. Your use of third-party sites is governed by their terms.
9. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. THIS SECTION DOES NOT LIMIT ANY DUTIES WE OWE YOU UNDER APPLICABLE INSURANCE LAW IN CONNECTION WITH LICENSED INSURANCE SERVICES WE ACTUALLY PROVIDE TO YOU.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEALTHLINK AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST COVERAGE OPPORTUNITIES, MISSED DEADLINES, OR MEDICAL OR OTHER COSTS ARISING FROM OR RELATING TO YOUR USE OF THE SITE OR RELIANCE ON SITE CONTENT.
OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY ARISING UNDER STATE INSURANCE LAWS FOR LICENSED SERVICES WE PROVIDE.
11. Indemnification
You agree to indemnify and hold harmless HealthLink and its owners, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or information you submit that is false or that you were not authorized to provide.
12. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict of laws principles, except that the arbitration provision in Section 13 is governed by the Federal Arbitration Act. Where Section 13 does not apply, exclusive venue lies in the state or federal courts located in Sangamon County, Illinois, and you consent to their jurisdiction.
13. Dispute Resolution — Arbitration and Class Action Waiver
Informal resolution first. Before filing any claim, you agree to contact us at legal@cobrainsurance.health with a written description of the dispute and give us 30 days to resolve it.
Arbitration. Except for the exclusions below, any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be held in your county of residence or remotely by videoconference. We will pay arbitration fees to the extent required by the AAA consumer rules or applicable law.
Class action waiver. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS. NEITHER PARTY MAY PARTICIPATE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court.
Exclusions. Either party may (a) bring an individual claim in small claims court, and (b) seek injunctive relief in court for infringement or misuse of intellectual property. Nothing in this Section limits your right to file a complaint with your state insurance department or any other regulator.
30-day opt-out. You may opt out of this arbitration provision by emailing legal@cobrainsurance.health within 30 days of first accepting these Terms, stating your name, contact information, and that you opt out of arbitration.
14. Changes; Termination
We may modify these Terms at any time by posting the updated version with a new "Last updated" date; material changes will be flagged with additional notice. Your continued use after changes take effect constitutes acceptance. We may suspend or terminate Site access at our discretion. Sections 2, 7, and 9–13 survive termination.
15. Miscellaneous
If any provision of these Terms is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and any consent language you accept on our forms are the entire agreement between you and HealthLink regarding the Site. You may not assign these Terms; we may assign them in connection with a business transfer.
